Aliyev's Recent Blog Post - Rhetorics of a Hauted?

Although I am tired of playing a return ball to Dr. Aliyev’s ongoing „op-ed“ war against my person and Eurasian Transition Group, I would like to give a brief comment on his recent blog post. At the same time, let me underline the fact that I am not willing to participate further in a publishing battle with accusations and responds of a fugitive, whose personal reputation is at least doubtable.

Dr. Aliyev published a blog post yesterday, in which he mixes several, in my view unconnected pieces to one so-called article. He is saying that „the German spin doctor Michael Laubsch is guilty of defamation and was sentenced to pay a huge fine by a court in Vienna.“ Speaking in kind words, this is a more or less naive interpretation of the facts.

After Dr. Aliyev and his PR-company Brandstätter Business Communications published a press release, saying that I am in friendly and permanent contact with the Kazakh Security Service KNB, I decided to use judicial ways for revoking this lie. Although my lawyer issued a revocation application not only for the agency, but also for Dr. Aliyev, the Vienna court was not able to deliver the petition to Aliyev’s Austrian postal address, his lawyers refused to receive it, saying that he would be no longer living in Austria. Therefore, we only could take legal actions against Brandstätter Business Communications.

In the decision of the court, the judge said that all claims made by us were rightful and that Brandtstätter has to revoke its statement against my person. Right after this judgement, the PR-agency used its legal right to an appeal to a court of first instance. The decision of the judge here was in favour of Brandstätter, saying that it is not a bad reputation having contact with foreign secret services and that our sources we used for our investigations could be ones based in the KNB.

No word about guilt, penalty, etc., because we did not take legal actions in the criminal law and we were the party that made a court appeal. Therefore, we were only asked to cover the lawyer’s costs of Brandstätter’s side, which is common practice in all Western judiciaries.

It also has to be noted that we did not accept the second judgement and will make an appeal to a court of second instance, which then will be the final stage for both sides to have a legal decision.

Maybe Brandstätter Business Communications did not inform its client Dr. Aliyev correctly about the current status of the judicial proceedings in this case, or Dr. Aliyev as a medic is not familiar with judicial terms, otherwise the blog entry does not make any sense, especially when Dr. Aliyev is adding stories about legal investigations against him in Berlin, that have no connection to our case and ETG’s former and present dialogue with all civil and political groups in Kazakhstan, an essential part of our work.
